class=\"wp-block-paragraph\">\u7136\u800c\uff0c\u5728\u8de8\u5883\u503a\u52a1\u8ffd\u7d22\u5b9e\u8df5\u4e2d\uff0c\u503a\u52a1\u4eba\u5f80\u5f80\u901a\u8fc7BVI\u6ce8\u518c\u7684\u79bb\u5cb8\u5b9e\u4f53\u9690\u85cf\u6216\u8f6c\u79fb\u8d44\u4ea7\uff0c\u8fd9\u7ed9\u503a\u6743\u4eba\u5e26\u6765\u5de8\u5927\u6311\u6218\u3002<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">\u4e3a\u6709\u6548\u5e94\u5bf9\u6b64\u7c7b\u60c5\u51b5\uff0cBVI\u6cd5\u5f8b\u4f53\u7cfb\u63d0\u4f9b\u4e86\u591a\u79cd\u4fe1\u606f\u62ab\u9732\u673a\u5236\uff0c\u8fd9\u4e9b\u673a\u5236\u5df2\u6210\u4e3a\u503a\u6743\u4eba\u8ffd\u7d22\u8d44\u4ea7\u7684\u5f3a\u5927\u5de5\u5177\u3002<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">\u8fd9\u4e9b\u5de5\u5177\u57fa\u4e8eBVI\u4e25\u683c\u7684\u6cd5\u5b9a\u548c\u76d1\u7ba1\u8981\u6c42\uff0c\u7279\u522b\u662f\u53d7\u76ca\u6240\u6709\u6743\u53ca\u5176\u4ed6\u6570\u636e\u7684\u8bb0\u5f55\u4e49\u52a1\uff08\u8be6\u89c1\u4fdd\u5bc6\u6307\u5357\uff09\uff0c\u4e3a\u503a\u6743\u4eba\u63d0\u4f9b\u4e86\u83b7\u53d6\u5173\u952e\u4fe1\u606f\u7684\u9014\u5f84\u3002<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">\u672c\u6587\u5c06\u5168\u9762\u63a2\u8ba8BVI\u4e3b\u8981\u7684\u4fe1\u606f\u62ab\u9732\u547d\u4ee4\u7c7b\u578b\uff0c\u5305\u62ecNorwich Pharmacal\u547d\u4ee4\u3001Bankers Trust\u547d\u4ee4\u3001\u7981\u8a00\u547d\u4ee4\u30012006\u5e74\u8bc1\u636e\u6cd5\u76f8\u5173\u89c4\u5b9a\u3001Anton Piller\u547d\u4ee4\u4ee5\u53ca\u8bf7\u6c42\u4fe1\u673a\u5236\uff0c\u4ee5\u671f\u4e3a\u8de8\u5883\u8d44\u4ea7\u8ffd\u7d22\u63d0\u4f9b\u53c2\u8003\u3002<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">\u672c\u6587\u6e90\u81ea\u300c\u8de8\u5883\u6e05\u6536\u767e\u79d1\u300d\u7cfb\u5217\uff0c\u7531\u675c\u56fd\u680b\u5f8b\u5e08\u56e2\u961f\u521b\u4f5c\uff0c\u805a\u7126\u6d77\u5916\u8d44\u4ea7\u8c03\u67e5\u3001\u5883\u5916\u8bc9\u8bbc\u4e0e\u6267\u884c\uff0c\u52a9\u529b\u503a\u6743\u4eba\u548c\u4ece\u4e1a\u8005\u638c\u63e1\u503a\u6743\u6d77\u5916\u6e05\u6536\u57fa\u7840\u73af\u8282\u3002<\/p>\n\n\n\n<div class=\"wp-block-paragraph\">Norwich Pharmacal\u547d\u4ee4\u662fBVI\u6cd5\u5f8b\u4e2d\u6700\u4e3a\u6210\u719f\u548c\u5e38\u7528\u7684\u4fe1\u606f\u62ab\u9732\u6551\u6d4e\u5f62\u5f0f\uff0c\u65e8\u5728\u5141\u8bb8\u906d\u53d7\u4e0d\u6cd5\u884c\u4e3a\u7684\u53d7\u5bb3\u8005\u4ece\u7b2c\u4e09\u65b9\u83b7\u53d6\u5fc5\u8981\u4fe1\u606f\uff0c\u4ee5\u8ffd\u7d22\u771f\u6b63\u7684\u4e0d\u6cd5\u884c\u4e3a\u4eba\u3002BVI\u6cd5\u9662\u901a\u8fc7\u53d1\u8fbe\u7684\u5224\u4f8b\u6cd5\u548c\u7a0b\u5e8f\u89c4\u5219\uff0c\u5f3a\u5316\u4e86\u5bf9\u6ce8\u518c\u4ee3\u7406\uff08Registered Agent\uff09\u7b49\u5173\u952e\u673a\u6784\u7684\u62ab\u9732\u4e49\u52a1\u3002<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">\u8fd9\u4e9b\u6ce8\u518c\u4ee3\u7406\u4f5c\u4e3a\u516c\u53f8\u5728BVI\u7684\u5b9e\u4f53\u5b58\u5728\u70b9\uff0c\u8d1f\u8d23\u4e0e\u516c\u53f8\u6ce8\u518c\u5904\u8054\u7edc\uff0c\u5e76\u627f\u62c5\u5907\u6848\u548c\u5408\u89c4\u8d23\u4efb\uff0c\u56e0\u6b64\u6301\u6709\u5927\u91cf\u516c\u53f8\u76f8\u5173\u6570\u636e\u3002<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">\u6839\u636eBVI\u4e0a\u8bc9\u6cd5\u9662\u5728BTA Bank v Fidelity Corporate Services Limited\uff08HCVAP 2010\/035\uff09\u4e00\u6848\u4e2d\u7684\u88c1\u51b3\uff0c\u5373\u4f7f\u6ce8\u518c\u4ee3\u7406\u4ec5\u63d0\u4f9b\u57fa\u672c\u7684\u6ce8\u518c\u4ee3\u7406\u670d\u52a1\uff0c\u5373\u8db3\u4ee5\u6784\u6210\u201c\u6d89\u5165\u201d\u4e0d\u6cd5\u884c\u4e3a\uff0c\u4ece\u800c\u4ea7\u751f\u62ab\u9732\u4e49\u52a1\u3002<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">\u8be5\u6848\u786e\u7acb\uff0c\u5373\u4f7f\u7b2c\u4e09\u65b9\u65e0\u610f\u6216\u65e0\u8bc1\u636e\u8bc1\u660e\u5176\u76f4\u63a5\u53c2\u4e0e\u4e0d\u6cd5\u884c\u4e3a\uff0c\u53ea\u8981\u5176\u6301\u6709\u6709\u52a9\u4e8e\u53d7\u5bb3\u8005\u8bc6\u522b\u771f\u6b63\u4e0d\u6cd5\u884c\u4e3a\u4eba\u7684\u4fe1\u606f\uff0c\u5373\u987b\u62ab\u9732\u3002Norwich Pharmacal\u547d\u4ee4\u9002\u7528\u4e8e\u8bc9\u8bbc\u524d\u9636\u6bb5\uff0c\u53ef\u9488\u5bf9\u65e0\u8f9c\u6d89\u5165\u6216\u534f\u52a9\u4e0d\u6cd5\u884c\u4e3a\u7684\u7b2c\u4e09\u65b9\u7533\u8bf7\u3002\u7533\u8bf7\u4eba\u987b\u8bc1\u660e\u6240\u6c42\u4fe1\u606f\u4e0e\u8ffd\u7d22\u4e0d\u6cd5\u884c\u4e3a\u4eba\u76f4\u63a5\u76f8\u5173\u4e14\u5fc5\u8981\u3002<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">\u5728\u8de8\u5883\u8d44\u4ea7\u8ffd\u7d22\u4e2d\uff0c\u6b64\u7c7b\u547d\u4ee4\u7279\u522b\u9002\u7528\u4e8e\u4ece\u6ce8\u518c\u4ee3\u7406\u83b7\u53d6\u516c\u53f8\u53d7\u76ca\u4eba\u3001\u80a1\u4e1c\u7ed3\u6784\u6216\u4ea4\u6613\u8bb0\u5f55\u7b49\u4fe1\u606f\uff0c\u5e2e\u52a9\u503a\u6743\u4eba\u8ffd\u8e2a\u9690\u85cf\u5728BVI\u516c\u53f8\u7684\u8d44\u4ea7\u3002<\/p>\n\n\n\n<h2 class=\"wp-block-heading\"><span class=\"ez-toc-section\" id=\"%E4%BA%8C%E3%80%81Bankers_Trust%E5%91%BD%E4%BB%A4\"><\/span>\u4e8c\u3001Bankers Trust\u547d\u4ee4<span class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">Bankers Trust\u547d\u4ee4\u662f\u53e6\u4e00\u79cd\u9488\u5bf9\u7b2c\u4e09\u65b9\u7684\u62ab\u9732\u6551\u6d4e\uff0c\u9002\u7528\u4e8e\u503a\u6743\u4eba\u5df2\u521d\u6b65\u8bc1\u660e\u5b58\u5728\u6b3a\u8bc8\u6216\u4fe1\u6258\u8fdd\u53cd\u60c5\u5f62\uff0c\u4e14\u9700\u83b7\u53d6\u4fe1\u606f\u4ee5\u8ffd\u7d22\u3001\u8ffd\u8e2a\u6216\u4fdd\u5168\u4e13\u6709\u6743\u5229\u4e3b\u5f20\u7684\u8d44\u4ea7\u3002\u8be5\u547d\u4ee4\u901a\u5e38\u9488\u5bf9\u94f6\u884c\u7b49\u91d1\u878d\u673a\u6784\uff0c\u7a81\u7834\u5176\u4fdd\u5bc6\u4e49\u52a1\uff0c\u63d0\u4f9b\u53ef\u80fd\u53d7\u4fdd\u62a4\u7684\u4fe1\u606f\u3002<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">\u4e0eNorwich Pharmacal\u547d\u4ee4\u7c7b\u4f3c\uff0c\u4f46Bankers Trust\u547d\u4ee4\u6709\u4e24\u70b9\u5173\u952e\u533a\u522b\uff1a\uff08a\uff09\u65e0\u9700\u8bc1\u660e\u53d7\u8bbf\u65b9\u6d89\u5165\u4e0d\u6cd5\u884c\u4e3a\uff1b\uff08b\uff09\u4ec5\u9650\u4e8e\u503a\u6743\u4eba\u5bf9\u76f8\u5173\u8d44\u4ea7\u4eab\u6709\u4e13\u6709\u6743\u5229\u7684\u60c5\u5f62\uff0c\u800c\u975e\u4e00\u822c\u635f\u5bb3\u8d54\u507f\u4e3b\u5f20\u3002\u8be5\u6551\u6d4e\u6e90\u4e8eBankers Trust v Shapira [1980] 1 WLR 1274\u4e00\u6848\uff0c\u5176\u4e2d\u6cd5\u9662\u51c6\u8bb8\u62ab\u9732\u94f6\u884c\u8bb0\u5f55\uff0c\u4ee5\u8f85\u52a9\u7533\u8bf7\u4eba\u8ffd\u8e2a\u88ab\u632a\u7528\u8d44\u91d1\u3002\u8be5\u6848\u5f3a\u8c03\uff0c\u7533\u8bf7\u4eba\u65e0\u987b\u5bf9\u94f6\u884c\u672c\u8eab\u4eab\u6709\u6743\u5229\uff0c\u4f46\u987b\u8bc1\u660e\u8d44\u91d1\u4e3a\u5176\u6240\u6709\u3002<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">\u7533\u8bf7Bankers Trust\u547d\u4ee4\u9700\u63d0\u4f9b\u5f3a\u6709\u529b\u7684\u6b3a\u8bc8\u8bc1\u636e\uff0c\u5305\u62ec\uff1a\uff08i\uff09\u5408\u7406\u7406\u7531\u76f8\u4fe1\u8d44\u91d1\u4e3a\u5176\u6240\u6709\uff1b\uff08ii\uff09\u7d27\u6025\u884c\u52a8\u5fc5\u8981\u6027\uff08\u5982\u8d44\u4ea7\u6563\u5931\u98ce\u9669\uff09\u3002\u6cd5\u9662\u5c06\u6743\u8861\u5bf9\u53d7\u8bbf\u65b9\u9690\u79c1\u7684\u4fb5\u72af\u4e0e\u7533\u8bf7\u4eba\u6f5c\u5728\u635f\u5bb3\uff0c\u5e76\u5728\u5408\u9002\u60c5\u5f62\u4e0b\u6388\u4e88\u5e7f\u6cdb\u7684\u62ab\u9732\u4ee4\u3002\u4e00\u65e6\u521d\u6b65\u8bc1\u660e\u6210\u7acb\uff0c\u6cd5\u9662\u503e\u5411\u4e8e\u5bbd\u677e\u89e3\u91ca\u547d\u4ee4\u8303\u56f4\uff0c\u4ee5\u652f\u6301\u8d44\u4ea7\u4fdd\u5168\u3002<\/p>\n\n\n\n<p class=\"ez-toc-section-end\"><\/span><\/h2>\n\n\n\n<p class=\"wp-block-paragraph\">BVI\u6cd5\u9662\u4eab\u6709\u56fa\u6709\u7ba1\u8f96\u6743\uff0c\u53ef\u5728\u4e0eNorwich Pharmacal\u6216Bankers Trust\u547d\u4ee4\u7ed3\u5408\u65f6\uff0c\u6388\u4e88\u7981\u8a00\u547d\u4ee4\uff08Gagging Orders\uff09\uff0c\u7981\u6b62\u53d7\u8bbf\u65b9\u5411\u9884\u5b9a\u88ab\u544a\u901a\u62a5\u62ab\u9732\u547d\u4ee4\u7684\u5b58\u5728\u3002\u6b64\u6551\u6d4e\u65e8\u5728\u9632\u6b62\u88ab\u544a\u63d0\u524d\u9500\u6bc1\u8bc1\u636e\u6216\u8f6c\u79fb\u8d44\u4ea7\uff0c\u786e\u4fdd\u62ab\u9732\u8fc7\u7a0b\u7684\u6709\u6548\u6027\u3002<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">\u7981\u8a00\u547d\u4ee4\u901a\u5e38\u5728\u5355\u65b9\u9762\uff08ex parte\uff09\u7533\u8bf7\u4e2d\u4e00\u5e76\u6388\u4e88\u3002\u8fdd\u53cd\u7981\u8a00\u547d\u4ee4\u53ef\u80fd\u5f15\u53d1\u85d0\u89c6\u6cd5\u9662\u7f6a\uff08contempt proceedings\uff09\uff0c\u4ece\u800c\u5f3a\u5316\u5176\u5a01\u6151\u529b\u3002\u5728\u8de8\u5883\u8d44\u4ea7\u8ffd\u7d22\u4e2d\uff0c\u6b64\u673a\u5236\u7279\u522b\u91cd\u8981\uff0c\u53ef\u907f\u514d\u503a\u52a1\u4eba\u901a\u8fc7BVI\u5b9e\u4f53\u8fc5\u901f\u53cd\u5e94\uff0c\u5bfc\u81f4\u4fe1\u606f\u6d41\u5931\u3002<\/p>\n\n\n\n<h2
